Soyo - The Soyo District Court, in the province of Zaire on Monday sentenced the chief of the secretary of the Attorney General's Office (PGR), Filipe Monteiro Fubá, to 12 years in prison for document forgery crimes.
The court also sentenced the defendant, who also served the criminal area of the District of Soyo, to pay a court fee of AOA 90.000,00 (US$97,2).
According to judges' decision, Filipe Monteiro Fubá, 43 years old, received from the Public Prosecutor's Office at the Criminal Investigation Service (SIC) cases to distribute to prosecutors, to issue an indictment.
Among these files, he received a criminal case which included 30 defendants, 22 of whom were citizens of the Democratic Republic of Congo (DRC) in an illegal migration situation, and some assets seized, including an amount of AOA 900.000,00 (US$972).
According to the sentence, October 2023, the defendant did not distribute the aforementioned case to the competent Public Prosecutor's Office and appropriated AOA 800k of the AOA 900k of the seized value.
To try to escape a disciplinary process for withholding a case with arrested defendants, Filipe Monteiro Fubá forged the signature of the Public Prosecutor's Office and put it on 22 release warrants, which he later sent to the Kivanda penitentiary establishment, in the municipality of Soyo.
The defendant was acquitted of the crime of embezzlement, of which he was also accused, as the court considered it to be a minimum amount of that provided for in the Angolan Penal Code, for this type of offense.
Among the mitigating situations, the ruling of the Soyo District Court pointed out the defendant's repentance, the reparation of the property damage which was the return of the amount of money spent, as well as the absence of a criminal record.
