Luanda - The speciality committees of the National Assembly on Friday approved in generality the Law Proposal of the new Code of Administrative Procedure, which will go to a global final vote in the plenary on the 24th of this month.
The Joint Opinion Report, approved unanimously, stresses that the diploma incorporates, for the first time, the principle of constitutionality of the administrative act.
The Code seeks to adapt the procedural rules on administrative litigation to the legal and constitutional reality and to make effective the fundamental rights and freedoms of citizens enshrined in the Constitution of the Republic of Angola.
It also introduces the possibility of administrative procedures being carried out in national languages and puts an end to the so-called administrative silence, obliging administrations to respond to acts within a certain period of time, among other new elements.
At the same session, the deputies gave a favourable opinion to the Law Proposal for the Statute of the Recovery or Insolvency Administrator, which establishes the disciplinary regime of administrators, as liberal professionals.
The Bill provides that in cases of extrajudicial reorganisation, the administrator is appointed by the parties, while in judicial reorganisation and insolvency the same is appointed by the judge, observing the rules established by law.
The committees also approved the Proposed Law on the General Regime of Administrative Offences, which distinguishes fines from penalties, the former being a purely criminal penalty of a pecuniary nature whose application is subject to the principle of the reserve of the judge.
International Treaties
The resolution approving the ratification by the country of the African Charter on Statistics was also approved.
This diploma enshrines principles aimed at guaranteeing national and scientific independence and impartiality with regard to the collection of statistical data, data reliability, protection of individual data and the sources of information of each State Party.
The African Union has made efforts to promote the political and economic independence of its member states by fostering economic models and regional integration, in order to strengthen the development capacity of each country.
With a view to materialising this assumption, the African Charter on Statistics was adopted, which Angola intends to adhere to.
The deputies also approved the draft resolution that approves the country's accession to the African Trade Insurance Agency.
The draft resolutions that ratify the Protocol relating to an Amendment to Article 56 of the Convention on International Civil Aviation and the accession to the Convention on Offences and other commercial acts on board aircraft.
